SharedShots Terms of Service

These Terms govern the use of SharedShots: the mobile application (the "App") and the sharedshots.site website, including the web album viewer, which can also be used to view and add photos. In these Terms, "the user" means the person who downloads, registers for, or uses SharedShots, and "the developer" means the operator and provider of SharedShots. By using SharedShots the user agrees to these Terms. A user who does not agree must not use it.
1. Eligibility
The user must be at least 13 years old to use SharedShots. A user between 13 and the age of majority in their place of residence must have a parent's or guardian's permission.
2. The user's account
The user is responsible for keeping their account credentials safe and for everything that happens under their account. The user should notify the developer at sharedshots.support@gmail.com if they suspect unauthorized access.
3. Purchases and payments
SharedShots is free to download, and viewing, joining, and taking part in an album is always free for every member. Two optional purchases exist:
- Event Pass. A one-time in-app purchase that unlocks a single album for every member of it, free or Premium, with nothing for the other members to pay. The price is calculated from the exact allowances the buyer selects (people, photos, video, photo quality, album lifetime, and whether the "Made with SharedShots" notice is removed), all shown before purchase. A pass buys capacity, not time: unless the buyer also pays the separate lifetime extension, the album keeps the same 3-month lifetime a free album has. The extension is offered at the time of purchase and takes the album to 6 or 9 months. Buying a further pass on the same album never reduces its existing allowances or shortens its lifetime, and can extend both. It is not a subscription, does not auto-renew, and once redeemed onto an album it cannot be moved to a different album.
- Split contributions ("chip-ins"). Members of an album may optionally split the cost of an Event Pass. Each chip-in is its own one-time in-app purchase that adds credit toward that album's pass; the album unlocks automatically when the combined contributions reach the pass price, and until then the album keeps its free-plan limits. A member's unspent contribution to an open split can be moved back to their chip-in credit inside the App and used toward any other split, but chip-in purchases are processed by the app store the App was installed from, and refunds outside the App are subject to that store's refund policy.
- Billing. Premium is sold as an auto-renewable subscription through the user's Apple App Store or Google Play account, depending on which store the App was installed from. The current price and billing period are shown on the in-app paywall before purchase.
- Auto-renewal. A subscription renews automatically at the end of each period unless the user cancels at least 24 hours before it ends. The user's App Store or Google Play account is charged at confirmation of purchase and again at each renewal.
- Introductory offers. Any introductory or discounted price applies only to eligible new subscribers for the stated period, after which the subscription renews at the standard price.
- Managing and cancelling. Subscriptions can be managed or cancelled at any time from the store the subscription was bought through. On iOS: Settings, then the user's name, then Subscriptions. On Android: the Play Store app, then the profile icon, then Payments and subscriptions. Cancelling stops future renewals; the current paid period stays active until it ends.
- Refunds. Purchases are processed by the app store the App was installed from and are subject to that store's refund policy. The developer generally cannot issue refunds directly; refund requests should be made through that store.
- Free-plan limits. A free album currently holds up to 50 photos, 1 minute of video and 5 people, and lasts 3 months. A user may be in up to 3 albums at a time, joined or hosted, and gets 4 of the 9 film filters. Capturing while offline, with photos uploading on reconnect, is included on every plan. Photos download in HD on every plan, including free. Free albums display a small "Made with SharedShots" notice, which is removed when the album has a paid Event Pass.
- What an album holds belongs to the album. Every member of an album sees all of it, on any plan; there is no per-person cap on how many photos of an album a member can see. An Event Pass therefore opens one album for everyone in it, with the people, photo and video allowances the buyer selected, and those allowances come from that album's own pass whoever hosts it. Joining someone else's album does not change what that album holds, whatever plan the joiner is on.
- What Premium is. Premium is a personal subscription for people who host often. It raises what the albums the subscriber hosts hold, to 150 photos, 5 minutes of video, unlimited guests and a 12-month lifetime instead of 3 months, removes the "Made with SharedShots" notice from those albums, unlocks all 9 filters in every album the subscriber is in, and removes the limit on how many albums they can host or join. It does not resize albums hosted by other people. The developer may change the limits or benefits with reasonable notice.
- Albums are temporary and are automatically deleted. SharedShots is a tool for sharing photos around an event, not cloud storage or backup. Every album has a limited lifetime and is permanently and automatically deleted when it ends, along with all photos and videos in it: currently 3 months for a free album or one with a base Event Pass, 6 or 9 months where the pass buyer also paid for the lifetime extension (extendable by renewing), and 12 months for an album hosted by a Premium subscriber. The App shows a countdown and its exact deletion date, and reminds members at 30, 14, 7, 3 and 1 days before deletion, but deletion cannot be undone and deleted content cannot be recovered. Users must download and keep their own copies of any photos they want to keep, before the album is deleted. The developer is not responsible for content the user did not save elsewhere, and may change these lifetimes with reasonable notice.
- Payment data. The developer never receives or stores card details. The app store handles payment. The developer receives only the user's purchase status in order to unlock what was bought.
4. Acceptable use
The user agrees NOT to use SharedShots to:
- Upload or share content that is illegal, defamatory, harassing, threatening, abusive, hateful, sexually explicit, or that infringes someone else's rights.
- Upload nudity, child sexual abuse material (CSAM), or any sexual content involving minors. There is zero tolerance. The developer will remove the content, ban the account, and report to relevant authorities.
- Stalk, dox, or otherwise harm someone.
- Impersonate another person or misrepresent an affiliation.
- Attempt to gain unauthorized access to SharedShots systems or other users' data, or run automated scraping or abuse against the App.
- Distribute malware or attempt to disrupt the service.
The developer may remove content and terminate accounts that violate these rules, with or without notice, at its sole discretion.
5. Albums, membership, and moderation
The host of an album (its creator) controls that album. The host can require approval before a new person may join, can approve or decline join requests, and can remove a member at any time. A removed member immediately loses access to the album; photos the removed member had already saved to their own device remain with them.
6. Content ownership and license
The user retains ownership of every photo, comment, and other content they upload. By uploading, the user grants the developer a worldwide, non-exclusive, royalty-free license to store, display, and transmit that content solely for the purpose of running the SharedShots service (for example, showing a photo to other members of the event it was uploaded to). This license ends when the user deletes the content or their account.
Content shared inside an event is visible to other members of that event. By joining or creating an event, every member consents to having their content shown to other members of that event.
When the user shares content in an event, the user grants every other member of that event a licence to view, download, save, and keep that content for their own personal use. This is a permission scoped to the members of the user's event. It does not place the content in the public domain, and the user keeps ownership of it. Because members save copies to their own devices, content that another member has already downloaded cannot be recalled or deleted by the developer even after the user deletes the original. Deleting content removes it from the App, not from copies others have already saved.
The user is solely responsible for the content they upload and for ensuring they have the right to share it (including any rights of people pictured). The developer does not pre-screen user content and is not responsible for content uploaded by users. The developer acts only as a neutral host that displays content among the members of a private event at their direction.
7. Reporting and blocking
A user who encounters content or another user that violates these Terms can:
- Open the photo, tap More, then Report photo. The user's email client opens with the photo identifiers pre-filled, ready to send.
- Block an individual user from their device, and that person's content disappears from the user's galleries.
The developer aims to review reports within 24 hours. Confirmed violations result in content removal and may result in account termination.
8. Service availability. Not a storage or backup service
SharedShots is provided "as is" and "as available". The developer may modify or discontinue features at any time.
SharedShots is a tool for sharing photos around an event. It is not a photo-storage, archival, or backup service and must not be relied on as one. Albums are temporary and are automatically and permanently deleted at the end of their lifetime (see section 3), and content may also become unavailable through outages, technical failure, account or album deletion, enforcement of these Terms, or discontinuation of the service. The developer does not guarantee continuous, error-free operation, nor that content will be retained or remain retrievable for any period of time. The user must download and keep their own original copies of any photos that matter to them, before an album is deleted. The developer accepts no liability for lost, corrupted, or unavailable content.
9. Account deletion
The user can delete their account at any time in the App (Profile, then Delete account). Deletion removes the user's profile, the events they own, their memberships, and the photos they uploaded. It is irreversible.
The developer may also terminate an account for breach of these Terms.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law:
- The App is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- The developer is not responsible or liable for user content, for any loss, deletion, exposure, or misuse of photos or other content, or for the conduct of any user (including other event members).
- The developer is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the App.
- The developer's total aggregate liability for any claim is limited to the greater of USD 50 or the amount the user paid to the developer in the 12 months before the claim.
11. Indemnification
The user agrees to defend, indemnify, and hold the developer harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from the user's content, the user's use of SharedShots, or the user's violation of these Terms or of anyone else's rights.
This includes any claim arising from the unauthorised use, upload, download, copying, or distribution of content by the user or by any other user, and from any content the user uploads without the right to share it. SharedShots and its developer are not liable for, and are held harmless from, any such unauthorised use, upload, or download of content shared on the platform.
12. If the App was downloaded from the Apple App Store
These Terms are between the user and the developer only. Apple is not a party to them and is not responsible for the App or its content.
- Apple has no obligation to provide any maintenance or support for the App.
- If the App fails to conform to any applicable warranty, the user may notify Apple, and Apple will refund the purchase price of the App. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind, and any other claim relating to the App is the developer's responsibility.
- Apple is not responsible for addressing any claim by the user or a third party relating to the App, including product liability claims, any claim that the App fails to meet a legal or regulatory requirement, and claims under consumer protection or similar law.
- If a third party claims the App infringes their intellectual property rights, the developer, not Apple, is responsible for investigating and resolving it.
- The user confirms they are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and are not on any US Government list of prohibited or restricted parties.
- Questions, complaints and support requests about the App go to sharedshots.support@gmail.com.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and on the user's acceptance of them Apple has the right to enforce these Terms against the user.
13. Governing law
These Terms, and any dispute arising from them or from use of the App, are governed by the laws of the Republic of South Africa, without regard to conflict-of-law rules. Nothing in this section takes away protections granted to consumers by mandatory laws of the country where the user lives.
14. Changes
The developer may update these Terms. Material changes will be announced in the App or by email. Continued use after a change indicates acceptance.
